When Do I Need to Copyright My Music?
According to the Copyright Act of 1976, your music is automatically copyrighted the day you create it. Any person who creates an original song or musical composition automatically owns the copyright protection on their recording or musical arrangement. The problem is, if somebody else commits copyright infringement and uses your music without permission, you may have a hard time proving that you are the original author. This is why it's best to register your music with the U.S. Copyright Office. By doing this, you create evidence, that you could use in court, which would help prove that you are the original author. It's also a good idea to register your music anyway, because courts require you register it first before you can bring about legal proceedings and sue someone.
How Do I Register My Music?
You can register your music by filling out an online form, titled eCO (Electronic Copyright Office), and submitting your music online electronically. There are other methods, such as filling out paper forms, such as form SR (for Sound Recordings), and mailing them to the U.S. Copyright Office. However, filing online is the cheapest, quickest, and easiest method to copyright music.
How Much Does it Cost to Copyright Music Online?
The fee to register online is $35. Which is much cheaper than the $65 fee required to file with paper forms. The time it takes to receive your registration certificate back is up to 9 months, but typically much sooner. I received mine within 2 months.
Do I Copyright Each Song Individually?
No, you can submit an entire album, or as many audio recordings as you have, all at once. You will only have to fill out one form, and pay one single fee, but the only negative aspect of doing this is that it will all be filed under one title. So when people try to access the copyright office record's to search for your songs, they may have a hard time finding them if they are looking for one of the other songs which are not named in the title.
If I Place a Copyright Symbol On My Album, Does that Prove My Music is Copyrighted?
No it does not. I'm sure you've seen the copyright symbol (©) on many albums, sometimes next to the phrase "all rights reserved". This does not prove that the music on the album is copyrighted. Any person can easily create a copyright symbol and place it on an album's cover or backcover. This does not secure any type of protection or registration. The main reason companies do this, is so that if somebody does infringe their copyrights, the infringer can not say that they did not know it was copyrighted. So the copyright symbol is more of like an added precaution, not sole protection.
How Long Does My Copyright Registration Last?
All original works that are registered for copyrights after 1976 do not have to be renewed. They will remain copyrighted forever.
What is the Poor-Man's Copyright?
Many people state that if you send a CD to yourself in the mail, and don't open it. The stamp on the package will serve as copyright registration. This is a myth, because no court has ever recognized this form of copyrighting as a substitute for copyright registration. You would still need to register your music before you could begin any legal proceedings against copyright infringers.
